Terms of Sale and Use

1. Purpose

These terms govern the use of the PADCRAFT website, published by Padcraft, a French sole proprietorship (micro-entreprise / auto-entrepreneur), SIRET 108 445 727 00010, registered address: Bernin, 38190, France — hereinafter "PADCRAFT", and the sale of its products and services: controller overlays for live streaming, custom controller designs, and the creator subscription allowing designs to be published and sold on the marketplace.

2. Acceptance of the terms

Using the site and its services implies full acceptance of these terms. Users who disagree with them are asked not to use the site.

3. User account

Creating an account requires a valid email address and a password. Users are responsible for keeping their credentials confidential and for all activity carried out from their account. PADCRAFT reserves the right to suspend an account in the event of fraudulent use or breach of these terms.

4. Description of the services

PADCRAFT provides:

  • A configurator to customize a controller overlay (colors, design) intended for use in streaming software (OBS or equivalent);
  • A catalog of community-made designs available for purchase;
  • A creator subscription allowing users to publish and sell their own designs, subject to a commission charged by PADCRAFT on each sale.

5. Orders and payment

Payments are processed by Stripe, a third-party payment provider, via a secure Stripe-hosted checkout page. PADCRAFT never has access to full card numbers. Accepted payment methods depend on what Stripe enables (typically Visa, Mastercard, and other major cards). All prices are displayed in US dollars ($). Payment is charged at the time of purchase; a confirmation email is sent automatically once payment is confirmed.

Each one-time Standard overlay-link purchase includes up to five changes to the design attached to that same link. A change is counted only when the user explicitly applies it from the configurator; editing or previewing the design does not consume a change. Once all five changes have been applied, the existing link continues to work with its last published design, but publishing another version requires the purchase of a new overlay link. A purchased overlay link may be disabled in the limited circumstances set out in Section 9, which also states when a refund or a replacement is offered.

6. Right of withdrawal — digital content

In accordance with the regulations applicable to digital content not supplied on a physical medium, the 14-day right of withdrawal may not apply once the download or access to the content has begun with the consumer's express consent, whereby the consumer acknowledges losing that right.

7. Creator subscription and commissions

New accounts that have never subscribed before may start the Creator plan with a 30-day free trial including up to 10 newly generated overlay links. Regenerating an existing link does not count as a new link, and deleting a generated link does not restore an allowance. Reaching the 10-link allowance does not end the trial and does not trigger a charge. Further link creation remains locked unless the user explicitly chooses to start the paid Creator plan early. Otherwise, unless cancelled first, the subscription automatically continues at the regular rate and billing begins only when the 30-day trial ends. A valid payment method is required to start the trial. The trial can be cancelled at any time from the billing page at no cost and is limited to one per account.

The Creator plan is offered at $11.99 per month (the Premium plan, $7.99 per month, does not include the ability to sell designs — see pricing.html for the current, authoritative rates). Subscription prices may change over time; existing subscribers will be notified in advance in accordance with Section 12 below, and any price change applies only from the next billing cycle onward — never retroactively for a period already paid. It allows an unlimited number of designs to be published on the marketplace and unlimited overlay-link creation over time, subject to an anti-abuse safety limit of 20 new links in any rolling 24-hour period. Capacity returns automatically as links become more than 24 hours old, and regenerating an existing link does not count. PADCRAFT charges a commission of 15% on each sale made through a creator's published designs; the remaining 85% is credited to the creator's balance. This rate may be changed by PADCRAFT at any time; creators will be notified in advance in accordance with Section 12 below, and any change applies only to sales made after the new rate takes effect — never retroactively.

Partner and Organization accounts may receive a creator code under a separate commercial arrangement. The commission percentage applicable to that code is the percentage displayed in the account's Creator code area at the time of each completed attributed sale. PADCRAFT may change that percentage at any time to reflect the applicable partnership arrangement. Any change applies only to sales completed after the new percentage takes effect and never reduces commission already credited. PADCRAFT will provide reasonable prior notice of a material reduction whenever practicable.

PADCRAFT may change, at any time, both the price of a subscription plan and what that plan includes: the features it gives access to, the allowances attached to it (such as the number of overlay links, the anti-abuse limits described above, or which tools are reserved to a paid plan), and the way those features work. A plan may also be renamed, merged with another, or withdrawn from sale.

Any such change is announced in advance, takes effect from the next billing cycle onward, and never applies retroactively to a period already paid for. A subscriber who does not accept a change may cancel from the billing page before it takes effect, at no cost and without penalty; continuing the subscription after that date constitutes acceptance of the new price and of the new plan contents.

Creators may request a payout of their balance once it reaches a minimum of $10. Payouts are currently processed manually by bank transfer within a few business days of the request (automated payouts are planned for a future update — see paiements.html for the current status). Creators remain solely responsible for declaring this income to the relevant tax authorities (in France, typically via the URSSAF micro-entrepreneur declaration if applicable to their own situation).

8. Intellectual property

The engine, code, visual identity and technical components of the PADCRAFT site are the exclusive property of PADCRAFT. Designs published by creators remain their property; by publishing them on the marketplace, the creator grants PADCRAFT a non-exclusive license to use them for the purpose of selling on the platform, and grants buyers a personal-use license for the design purchased.

By generating or saving an overlay through the PADCRAFT configurator, the user grants PADCRAFT a worldwide, royalty-free right to review, reproduce, adapt, improve, present and commercially distribute the resulting controller-overlay configuration as a PADCRAFT design. PADCRAFT may create an independent shop copy without changing the user's original OBS link. This permission applies only to rights the user is legally able to grant: uploading an image, font, animation or other third-party asset does not transfer that third party's intellectual-property rights to PADCRAFT, and the user remains responsible for having the necessary permissions.

9. Catalog management and user-published content

Each creator warrants that they hold the rights to the designs they publish (or have the necessary authorizations) and undertakes not to publish any content infringing third-party rights (copyright, trademarks, image rights).

By publishing a design on the marketplace, the creator also authorizes PADCRAFT to manage its listing as needed for the operation of the platform: correcting or editing its listing information (name, description, category, keywords), adjusting its price, or removing it from sale, at any time and at PADCRAFT's discretion — including without a rights-infringement reason and without requiring the creator's prior approval for each change. PADCRAFT will make reasonable efforts to inform the creator of significant changes made to their listing where practical. This does not affect the creator's underlying ownership of the design, nor their share of past sales already made.

PADCRAFT may also remove a published design from the catalog entirely, and may disable a specific generated overlay link, including after that design or link has been paid for. This applies in the following cases: a credible claim that the content infringes a third party's rights; content that breaches these terms or the shop rules; fraud, a payment chargeback, or use of a link beyond the device limit stated on the product page; a binding legal or regulatory request; a serious security or technical problem; a storage, hosting or infrastructure constraint on PADCRAFT’s side, including the loss, migration or removal of the stored assets a design depends on; or the retirement of a controller model or engine feature that the design depends on.

To keep hosting and generation costs sustainable, PADCRAFT may also retire redundant overlay links: where several links belonging to the same account point to the same design, or to designs that differ only marginally from one another, PADCRAFT may keep the most recent one and invalidate the older duplicates. Affected account holders are informed by email, and the compensation described in the next paragraph applies, since the reason for the removal lies with PADCRAFT and not with the buyer.

Where a paid design or overlay link is removed or disabled for a reason that is not attributable to the buyer, PADCRAFT will offer, at the buyer's choice, either a replacement of equivalent value or a refund of the amount paid for that design or link. For a subscription, the refund covers the part of the paid period that has not been used. Where the removal follows fraud, abuse, or a breach of these terms by the buyer, no refund is due. PADCRAFT will give notice by email before disabling a paid overlay link whenever it is practical to do so, except where an immediate takedown is required by law or by a rights holder's claim.

10. Liability

PADCRAFT makes every effort to ensure the availability and proper functioning of the site, without guaranteeing absolute continuity. PADCRAFT cannot be held liable for malfunctions related to the user's technical environment (browser, connection, third-party streaming software).

11. Termination

Users may delete their account at any time. PADCRAFT may terminate or suspend a user's access in the event of a serious breach of these terms, with prior notice where possible.

12. Changes to the terms

PADCRAFT reserves the right to modify these terms at any time. Users will be informed of substantial changes; continued use of the site constitutes acceptance of the new terms.

13. Governing law and disputes

These terms are governed by French law, regardless of the country the buyer or creator is located in. In the event of a dispute, an amicable solution will be sought before any legal action. In accordance with French consumer law, any consumer (a private individual, non-professional buyer) has the right to free recourse to a consumer mediator in the event of an unresolved dispute.
